Terms of Service

1. Description of Service

These Terms of Service ("Terms") govern your use of Virada: Jump Rope Classes, the mobile application formerly named Jump Start (the "Service"), provided by Virada LLC ("Company," "we," "us," or "our"). The Service is a jump rope training app for iOS that provides recorded, instructor-led classes and programs, interval timers, optional camera-based jump counting and tempo coaching, and workout statistics.

2. Acceptance and Changes to Terms

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. The Company reserves the right to modify these Terms at any time. Changes become effective immediately upon posting on this page. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Your use of the Service is also governed by our Privacy Policy.

3. Eligibility and Accounts

You must be 18 or older to create an account or subscribe. By creating an account you confirm that you are. We may close any account we find belongs to someone under 18 and delete its data.

An account is for one person. You are responsible for activity under your account and for keeping access to the Apple Account or email address you sign in with. Do not share your account or let others stream or download classes through it. You can delete your account at any time in the app under Profile, Delete account; deleting an account does not cancel an App Store subscription.

4. Not Medical Advice; Assumption of Risk

The Service provides general fitness programming for informational purposes only. It is not medical advice, and the Company is not a medical provider. Consult a physician before beginning this or any exercise program, particularly if you have a medical condition, an injury, or are pregnant. Stop exercising immediately if you feel pain, dizziness, or shortness of breath.

Jump rope is a physical activity that carries an inherent risk of injury. You voluntarily assume all risks associated with using the Service, including injury to yourself or others and damage to property or equipment. You are responsible for exercising in a safe environment, using appropriate equipment, and working within your own physical limits. Class lengths, intervals, tempo targets, and program progressions are general programming, not recommendations tailored to you, and the classes are recorded: no instructor is watching you or able to respond to you.

5. Subscription and Free Trial

Browsing the library is free. Taking classes, downloading them, and the timer and progress features require a subscription, offered monthly or annually at the price shown in the app before you buy. A new subscriber may be offered a free trial; when the trial ends the subscription begins and your Apple Account is charged unless you cancel at least 24 hours before the trial ends.

Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the period ends. Manage or cancel your subscription in your Apple Account settings; deleting the app or your account does not cancel it. Payment is processed by Apple under Apple's terms, and refunds are handled by Apple. We may change prices for future periods; Apple will notify you and, where required, ask for your consent first. The class library changes over time, and classes may be added or removed.

6. Camera Counting and Statistics

Camera-based jump counting runs on-device and produces estimates. Counts, pace, calorie figures, and other statistics are approximations and are not guaranteed to be accurate. Heart rate readings from a paired Bluetooth monitor are displayed as reported by the device and depend on its accuracy and fit. The Service is not a medical device, and none of its measurements should be used for medical purposes. The camera is used only on your device; the Service does not record or upload video of you.

7. Apple Health

If you enable Apple Health, the Service writes workouts and estimated calories to Apple Health on your device and reads heart rate during a session. Apple Health is operated by Apple, not the Company, and data written there is governed by Apple's terms and privacy protections. The Company is not responsible for the availability or behavior of Apple services.

8. Intellectual Property

The Service, including its software, design, classes, programs, video, and music, is owned by the Company or its licensors and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service on Apple devices you own or control, as permitted by the App Store terms. Classes you stream or download are for your personal, non-commercial use inside the app while your subscription is active. You may not copy, record, redistribute, publicly perform, or resell them, and you may not reverse engineer the Service or work around its access controls.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT JUMP COUNTS OR OTHER STATISTICS WILL BE ACCURATE, OR THAT USE OF THE SERVICE WILL PRODUCE ANY PARTICULAR FITNESS RESULT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, LOSS OF DATA, OR PROPERTY DAMAGE ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING INJURIES SUSTAINED WHILE EXERCISING. THE COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

11. Termination

You may stop using the Service at any time by deleting your account and the app. The Company may terminate or suspend access to the Service for violation of these Terms, including account sharing. Sections 4, 9, and 10 survive termination.

12. Earlier Versions

Versions of the app released under the name Jump Start (version 1.x) have no accounts or subscription and run entirely on your device, with the full program unlocked by a one-time purchase processed by Apple. Sections 3 and 5 do not apply to those versions.
