Terms of Service

1. Description of Service

These Terms of Service ("Terms") govern your use of the Jump Start mobile application (the "Service") provided by Virada LLC ("Company," "we," "us," or "our"). The Service is a jump rope training app for iOS that provides a structured 8-week program of guided sessions, interval timers, optional camera-based jump counting, and workout statistics. All processing runs on your device.

2. Acceptance and Changes to Terms

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. The Company reserves the right to modify these Terms at any time. Changes become effective immediately upon posting on this page. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Your use of the Service is also governed by our Privacy Policy.

3. Not Medical Advice; Assumption of Risk

The Service provides general fitness programming for informational purposes only. It is not medical advice, and the Company is not a medical provider. Consult a physician before beginning this or any exercise program, particularly if you have a medical condition, an injury, or are pregnant. Stop exercising immediately if you feel pain, dizziness, or shortness of breath.

Jump rope is a physical activity that carries an inherent risk of injury. You voluntarily assume all risks associated with using the Service, including injury to yourself or others and damage to property or equipment. You are responsible for exercising in a safe environment, using appropriate equipment, and working within your own physical limits. Session lengths, intervals, and progressions in the program are general defaults, not recommendations tailored to you.

4. Trial and Purchase

Part of the program is available for free, and the full program is unlocked by a one-time purchase. The unlock is a single non-consumable purchase, not a subscription. Payment is processed by Apple through the App Store under Apple's terms; refunds are handled by Apple. The purchase can be restored on any device signed into the same Apple Account.

5. Camera Counting and Statistics

Camera-based jump counting runs on-device and produces estimates. Counts, pace, calorie figures, and other statistics are approximations and are not guaranteed to be accurate. Heart rate readings from a paired Bluetooth monitor are displayed as reported by the device and depend on its accuracy and fit. The Service is not a medical device, and none of its measurements should be used for medical purposes. If you record video of your sessions, you are responsible for where and whom you film.

6. Apple Health

If you enable Apple Health sync, the Service writes workouts and estimated calories to Apple Health on your device. Apple Health is operated by Apple, not the Company, and data written there is governed by Apple's terms and privacy protections. The Company is not responsible for the availability or behavior of Apple services.

7. Intellectual Property

The Service, including its software, design, program content, and demonstration media, is owned by the Company and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service on Apple devices you own or control, as permitted by the App Store terms. You may not reverse engineer, resell, or redistribute the Service. Videos you record of your own sessions belong to you.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT JUMP COUNTS OR OTHER STATISTICS WILL BE ACCURATE, OR THAT USE OF THE SERVICE WILL PRODUCE ANY PARTICULAR FITNESS RESULT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, LOSS OF DATA, OR PROPERTY DAMAGE ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING INJURIES SUSTAINED WHILE EXERCISING. THE COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

10. Termination

You may stop using the Service at any time by deleting the app. The Company may terminate or suspend access to the Service for violation of these Terms. Sections 3, 8, and 9 survive termination.
