Terms of Service

1. Description of Service

These Terms of Service ("Terms") govern your use of the BarkWatch mobile application (the "Service") provided by Virada LLC ("Company," "we," "us," or "our"). The Service is a dog bark monitor that runs on two of your own iOS devices signed into the same Apple Account: one device listens for barking, detects and records bark events, and the other shows a timeline of events, plays back clips, and receives alerts. Event data syncs between your devices through your private iCloud database.

2. Acceptance and Changes to Terms

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. The Company reserves the right to modify these Terms at any time. Changes become effective immediately upon posting on this page. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Your use of the Service is also governed by our Privacy Policy.

3. Requirements and Apple Services

The Service requires two compatible iOS devices signed into the same Apple Account with iCloud enabled. Syncing and alert delivery depend on Apple's iCloud service and on network connectivity for both devices; neither is operated by the Company, and the Company is not responsible for interruptions, delays, or data unavailability caused by Apple services, your network, device power, or device settings.

4. Trial and Purchase

The Service offers a free trial measured from the date the app was installed, followed by a one-time purchase that permanently unlocks the Service. The unlock is a single non-consumable purchase, not a subscription. Payment is processed by Apple through the App Store under Apple's terms; refunds are handled by Apple. The purchase can be restored on any device signed into the same Apple Account.

5. No Safety or Emergency Monitoring

The Service is a convenience tool for observing barking. Bark detection is performed by an on-device classifier and is not guaranteed to detect every bark or to be free of false positives. Alert delivery is not guaranteed and may be delayed or fail due to factors outside the Company's control. The Service is not a security system, pet-sitting service, safety device, or emergency monitoring service, and must not be relied upon to protect the health, safety, or welfare of any animal, person, or property. The Service does not provide veterinary or behavioral advice.

6. Acceptable Use

You agree to use the Service only to monitor spaces and animals you are authorized to monitor. You are solely responsible for complying with all laws that apply to audio recording in your jurisdiction, including consent and notification requirements for people whose voices may be incidentally captured. You may not use the Service to record any person without lawful authority, nor reverse engineer, resell, or redistribute the Service.

7. Intellectual Property

The Service, including its software, design, and content, is owned by the Company and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service on Apple devices you own or control, as permitted by the App Store terms. Recordings created by the Service from your own environment belong to you.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EVERY BARK WILL BE DETECTED OR EVERY ALERT DELIVERED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROPERTY DAMAGE, OR HARM TO ANY ANIMAL OR PERSON, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. THE COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

You may stop using the Service at any time by deleting the app. The Company may terminate or suspend access to the Service for violation of these Terms. Sections 5, 6, 8, and 9 survive termination.
